Guwahati, July 11: Fish vendors selling fresh fish product including crustaceans treated with formalin which is highly toxic and injurious to health has come to the notice of Health & Family Welfare Department, Govt. of Assam. Regulation 3.1.4 of Food Safety Standards (Food Products Standards & Food Addictives) Regulations, 2011 indicates the preservatives permitted to be used in select articles of food and formalin has not been included in the said list of permitted preservatives. As such, distribution, storage and sale of fresh fish products treated with formalin or other unpermitted preservatives render the articles “Unsafe” under Section 3(1) (zz) (v) of Food Safety & Standards Act, 2006.
Therefore, in exercise of the power conferred under Clause (a) of Sub-Section (2) of Section 30 of Food Safety & Standards Act, 2006, it has issued a notification stating that storage, distribution or sale of fresh fish including crustaceans brought from outside the state is hereby prohibited in the state of Assam for a period of 10 (Ten) days and thereafter till corrective measures are taken from the date of issue of the notification Dated 10th July, 2018.
Failure to comply with the provisions of the Food Safety & Standards Act, 2006 and the Notification will attract penalties as provided in Section 34(4) and Section 59 of the Act which may extend to punishment with imprisonment upto 7 (seven) years and fine upto Rs. 10,00,000/- (Rupees Ten Lakhs) only as may be applicable. The Notification has been issued in interest of Public Health.
